36408 With reference to your Despatch No. 353 of the

21st. of November, I have the honour to transmit the enclosed

Memorial from Mr. P. Jacks, Assistant Land Officer, praying that

he may be allowed to participate in the scheme of Duty Pay applied among other Cadet appointments to those of Assistant Land Officers

in the New Territories.

With reference to Kr. Jacks' contention that

his emoluments should not be less than those of these Assistant

Land Officers I have to remark that the posts of Assistant Land

Officers in the New Territories no longer exist. They are now

combined with the appointments of District and Assistant District

Officers in which are comprised lagisterial and, at present,

Folice duties. A comparison can, therefore, not be legitimately

instituted between the three appointments.

The addition of duty pay to certain officers

to which Cadets have a preferential claim was, as you are aware made to remove a specific grievance under which the incumbents of those posts who are paid in sterling instead of in dollars suffer owing to the sterling salaries being less than the dollar salaries. The salary of the post which Mr. Jacks holds was increased when he was appointed from £440 to £500 to £420 to £540. He has, therefore, no claim to consideration on the ground of equal treatment.
